DOT Proposes Changes to Drug Testing Panel

The US Department of Transportation (DOT) has issued notice of proposed rulemaking – NPRM – to revise Part 40 to harmonize with the revised Department of Health and Human Services (HHS) Mandatory Guidelines for Federal Workplace Drug Testing Programs using Urine, which is expected to be effective October 1, 2017.

There are two primary changes to the HHS Mandatory Guidelines to which this notice proposes to harmonize Part 40.

[Ayr, ON] – Fentanyl is a synthetic opioid pain reliever used in the treatment of severe pain and is 50 to 100 times more potent than morphine, with a shorter duration of action. It is prescribed in both tablet and transdermal patch forms, but can be obtained illegally through internet delivery in powder form as well. Fentanyl has a high risk for misuse, addiction and abuse. Fentanyl use in safety sensitive positions can be extremely dangerous.

Substance misuse among medical professionals was back in the forefront recently after a Kitchener woman was charged with impaired driving and criminal negligence causing bodily harm for allegedly using drugs she stole from a patient while working as a home care nurse (see article Home-Care Nurse Charged After Allegedly Taking Drugs From Patient). While facing charges, the court ordered her to not act in a care capacity for anyone or for employment purposes.
